I am being sued by a collection agency for an old (over 3 years) Visa credit card debt. I live in Alabama and the Statue of Limitations on Open Accounts is 3 years. I hired an attorney but he says that I probably will have to settle because it is not an open account but a written contract account which has a SOL of 6 years. He says this because the collection agency produced a piece of paper that I signed when I opened the account (basically it's the credit card application). I researched on my own and most information that I found says that credit cards are always open accounts. I did find one place (Wiki Answers) where someone said that credit cards could be written contracts. Is my attorney wrong or can this indeed be a written contract in some way. I really need to know before I go to court. Please give me some type of solid backup to your answer and not just your opinion.

I live in the State of Georgia and am being sued over an old credit card that I defaulted on. It has been more than 4 years but less than 6 years since the date of default, so depending on whether credit card debt is considered an open account or a written contract in the State of Georgia, the Statute of Limitations may or may not apply. The Staute of Limitations is 4 years for open accounts and 6 years for written contracts. Does anyone know for certain which type applies for credit card debt in Georgia? The account is with Citibank MasterCard and was opened in the late 80's or early 90's. Thanks.

I am a renter thinking about purchasing a townhome or condo in my neighborhood for about 3-5 years, selling and then finally moving into my perm. home in the same neighborhood. My rent is increasing from 946 to 1011 a month and instead of wasting that money, I'd like to put it toward a home.

Problem: No savings, Poor credit history, Fico score between 499-526 from all three credit agencies 35/K a year, 6+ years with my job, and the loan amount I'm looking to finance is between 164-219/K.

I figured it would be cheaper for me to buy instead of renting which I'll be doing for the next 3-5 years if I can't get a home loan.

I know my credit situation is bleak. How long will it take to ramp my fico score to at least the national average and what other advice can anyone of you give for a first time home seeker looking to buy in the near future? What can I do for the next year to get my score up?

Oh I live in Houston, TX btw..

Thanks in Advance!!

Help! I'm trying to start up a business and all I need is a k business credit card. But I have a bad credit rating and so far lenders insist I must have a strong co-signer. But I can't get anyone to do this for me (long story) Any suggestions?
In answer to the first responder, it's a self-employed business. I'm the only employee. It's a long story but my personal financial mess is a combination of the high tech collapse (I'm an engineer) that has gone on 6 years, 3.5 years unemployed for myself. Plus, I have a medical condition. I finally made a bold move to get around the medical condition so I can start my own business, now all that is stopping me is a co-signer. I agree, it's not an enviable position but I have no other choice. Is there any way to get a credit card without a co-signer when you have a bad credit rating?

I want to get a debt conso loan from the credit union I just joined. I have a fair credit score of 645-650 depending on which credit report you pull. However, I also have a delinquent cell phone account for 00 thats about 6 years old. I'v applied for a similar loan at bank of america but got denied due to the delinquent account. I would really like the loan to pay the delinquent account and my credit cards off. What are the odds of me getting the loan at a credit union?

I apparently have REALLY bad credit. My lease is up at my apartment and I am looking to move. I put in an application for an apartment today and was denied because of my credit. I have never had a problem getting an apartment before, I have lived on my own in apt's for 5 years and never paid rent late, never broken a lease, and never left damages. I make ,000/year and could not get approved for a 0/month apt. I have been at my job for 6 years, and I am 24. Is this right? Should I keep looking? I don't want to keep paying application fees if I am not going to get approved. I live in Houston.
